Terms of service

Agreement
By using Formclock, you agree to these terms. If you are using it on behalf of a business, you agree on its behalf and confirm you are authorised to do so.
Formclock is operated by [Formclock operating entity, to be completed]. Until that is filled in, this is a good-faith, plain-language draft rather than a reviewed contract, and it is not legal advice.
The service
Formclock is workforce scheduling, time & attendance, and coverage automation delivered as a hosted product. We work to keep it available and improving; features may change as the product evolves, and we'll communicate meaningful changes.
Your account
You're responsible for activity in your workspace and for keeping access secure. You manage roles and permissions for your team. Notify us promptly of any unauthorized use.
Acceptable use
Use Formclock to schedule and manage your own workforce. Don't misuse the service, probe or breach the isolation between workspaces, reverse-engineer it, or use it to break the law or infringe others' rights.
Customer data & privacy
You own the data you put into Formclock. We process it to provide the service, per our Privacy Policy. You're responsible for having the rights and notices needed to put worker data into the product, including for optional features like clock-in photos.
Automation
The coverage agent acts only at the autonomy level you configure (suggest, act-with-approval, or act-and-report). Automated actions are logged and reversible. You remain responsible for schedules you publish and for compliance with applicable labour law.
Availability
We aim for high availability, and we do not promise the service will be uninterrupted or error-free. We publish no uptime figure and offer no service-level agreement, because we have not been running long enough for either to mean anything. Planned maintenance and factors outside our control can affect uptime. Any formal commitment would be set out in a separate agreement.
Fees and billing
Billing is not live. Formclock does not currently take payment, has no checkout, and stores no payment details of any kind. Every workspace is running without charge today, whatever plan it is on.
When billing does ship, paid plans will be charged per active user on the cycle shown at purchase, an active user being someone you schedule or track. Archived and deactivated people will not be charged for. We will publish the payment processor before it takes a card, and we will not begin charging an existing workspace without telling its admins first.
This section is deliberately written in the future tense. When it changes to the present tense, the product will have changed too.
Intellectual property
Formclock and its software remain ours. You get a limited, non-exclusive right to use the service. Feedback you share may be used to improve the product without obligation to you.
Disclaimers
The service is provided “as is” to the extent permitted by law. Formclock is a scheduling tool, not a payroll, tax, or legal-compliance service; you're responsible for your own compliance decisions.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential damages, and total liability is limited to the fees you paid in the prior 12 months. Nothing limits liability that can't be limited by law.
Termination
You can stop using Formclock at any time. Before you go, admins and managers can export people, payroll and audit data from the product as CSV.
For anything beyond that, including deleting a workspace outright, write to privacy@formclock.com. We handle those requests by hand and respond within 30 days. There is no self-service delete button today, and we would rather tell you so than let you assume there is one.
We may suspend or terminate accounts that violate these terms or create risk to the service or to other people.
Governing law & changes
The governing law and venue will be set out in your order or a separate agreement. We may update these terms; we'll change the date above and notify admins of material changes. Continued use means you accept the update.
